Overview

Join us for this webinar on the Central Bank of Ireland’s (CBI's) Individual Accountability Framework (IAF) on Thursday, 14th December 2023. The Framework was published on Thursday, 16th November 2023.

Following a three month consultation process, to which IoD Ireland responded on behalf of members, the CBI has published a Feedback Statement and issued Regulations and Guidance to firms on the IAF. The Guidance provides clarity regarding the CBI’s expectations for the implementation of three aspects of the framework: the Senior Executive Accountability Framework (SEAR), the Conduct Standards, and certain aspects of the enhancements to the Fitness & Probity regime.

In this webinar we will explore the key changes in the finalised Regulations and Guidance versus the original drafts. The webinar will also consider the implementation of the final Regulations and Guidance for Boards and senior executives of financial services institutions.

Josh Hogan is a Partner with McCann FitzGerald LLP. Josh specialises in financial services regulation and Fintech. Josh is top-ranked by IFLR1000 as a Market Leader and by Chambers Fintech Legal as Band 1.

Josh’s practice includes work relating to prudential and conduct regulation, authorisations, acquiring transactions, fitness and probity, compliance issues, transaction regulatory due diligence, regulatory investigations and remediation. He has deep experience advising clients in the areas of consumer and SME finance regulation, credit / hire purchase origination and servicing, electronic money, payment services, crowdfunding, MiFID, virtual / crypto assets, AML and market abuse.

Josh has a particular interest in how technology impacts upon the delivery of financial services. He engages extensively with the Fintech ecosystem in Ireland, including through industry/Government groups such as the Fintech Foresights Group and the Digital Assets Working Group. He is on the Governing Council of the Fintech & Payments Association of Ireland and co-chairs its Regulatory Insights Group. Josh is an officer of the Banking Law Committee of the International Bar Association. He co-chaired the IBA International Financial Law Conference (Venice, May 2022) and regularly publishes / speaks on regulatory and fintech topics. Josh has experience working on secondment from McCann FitzGerald in an international bank and in the Government Department's of Finance.

Donal Hamilton is a Partner with McCann FitzGerald LLP. He advises domestic and international employers on all aspects of the employment relationship, and has extensive experience advising on business transfer and outsourcing issues, corporate immigration, complex employee relations issues, and employment investigations, disputes and mediation. 

He represents clients before the WRC and Labour Court and advises organisations on complex industrial relations and contentious employment matters including the management of protected disclosures and the resolution of subsequent litigation. 

Donal has particular expertise advising clients on employment issues in regulated industries such as financial services, aviation, pharmaceuticals and med-tech.

Donal lectures in employment law on the Law Society of Ireland’s professional practice course and speaks widely on employment law issues. He is co-author of the chapter on Protected Leave in Bloomsbury’s Employment Law and regularly contributes to industry and national publications.
